Articify — Terms & Privacy Policy

Welcome to the Articify online store (the “Site”). The Site is operated by Gozo Graphics Ltd. (“Gozo Graphics”, “we”, “us”, “our”). Articify is a dedicated subdivision and brand of Gozo Graphics Ltd., focusing on personalised and off-the-shelf products such as prints, neon lights, desk lamps, canvas and acrylic prints, garments (tshirts, hoodies, sweatshirts, etc.), mugs, jigsaw puzzles, and other related items. By using the Site and purchasing our products, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please refrain from using the Site. We may update these Terms from time to time without prior notice. Continued use of the Site constitutes acceptance of the updated Terms. Section A sets out the Terms and Conditions of order and website use; Section B sets out our Privacy Policy for Articify in line with GDPR.

Section A — Terms and Conditions of Order (Articify)

1) Articify Satisfaction Guarantee

  • If you are not satisfied with your Articify purchase, contact our Customer Service at +356 9933 6964 or info@articify.com within 30 days from receipt (or scheduled arrival).
  • We run orders through an internal checklist. You are responsible for correcting issues we identify, or authorising us to proceed “as is”.
  • This satisfaction guarantee is subject to the exclusions listed under clauses 1.1 and 1.2 below.

1.1) File Submissions — Exclusions

  • Spelling, punctuation, or grammatical errors made by you in the provided text.
  • Inferior quality or low-resolution of uploaded images, screenshots, or photographs.
  • Design errors or colour selection errors introduced in your artwork or customisation choices.
  • Errors in user-selected options (for example product type, size, format, finishing, quantity, colour, or variant).
  • Incorrect dimensions, image orientation, bleed, safe areas, or files not meeting Articify / Gozo Graphics specifications.
  • Colour match issues where no approved hardcopy proof exists for the relevant product.
  • Delivery delays caused by improperly prepared files, outstanding approvals, or late responses.
  • Duplicate orders or duplicate file submissions made by the customer.
  • Incorrect file layout for manufacturing of signs, laser-cut items, 3D prints, or other specialised products where you supplied production files.

1.2) Shipping and Delivery — Exclusions

  • Incorrect shipping address, undeliverable packages, third delivery attempts, or other errors created by you.
  • Damage to products arising after delivery to you or your nominated recipient.
  • The satisfaction guarantee does not apply to shipping claims. We will reprint orders damaged or lost by the carrier in accordance with our carrier-claim procedures.
  • We may require return of the original order or photographic evidence of damage before reprinting or refunding.
  • We are not responsible for any damages or claims incurred by you or your business resulting from receiving items that are defective or incomplete, or that you receive later than the estimated delivery date.

2) Payment

  • Prices are in Euros (€) unless otherwise noted. By placing an order on Articify, you agree that all product charges, taxes, and shipping/processing fees may be charged to your selected payment method.
  • Once a job is approved and “sent to production/press”, no changes to artwork, job characteristics, options, or turnaround are allowed.
  • After a job reaches Articify’s prepress/production department, you are responsible for the full amount plus applicable taxes, shipping, and processing fees (unless otherwise noted).
  • No work proceeds until full payment is received or valid confirmation of payment is obtained (for example confirmed card or PayPal transaction, cleared bank transfer).

2.1) Approved Payment Methods

  • Payment via our online payment gateway (currently Revolut Payment Gateway or any replacement we list at checkout).
  • Other methods, if any, will be shown on the Site at checkout from time to time.

2.2) VAT Policy

Gozo Graphics Ltd. (trading as Articify) is required to collect and remit VAT on all taxable sales where applicable. An 18% VAT rate is typically charged on each product and is included in the price unless explicitly shown otherwise. Fiscal receipts or VAT invoices are provided upon pickup, with delivery documents, or electronically once payment is effected.

2.3) Late/Non-Payment & Remedies

If any amount remains unpaid, we may suspend production, withhold deliverables, and postpone shipment or collection until payment is received. For unpaid jobs over 60 days after delivery or notice that the job is ready, to the fullest extent permitted by applicable law and without prejudice to mandatory consumer rights, we may withhold or dispose of materials and suspend or revoke licences granted for production until payment is received. We may also refer unpaid accounts to collection and pursue any lawful remedies (including court proceedings) to recover amounts due, together with any court-awarded costs and statutory interest where applicable. For business customers only, you agree that failure to pay may result in the temporary transfer or assignment of rights in the specific production files created by Articify / Gozo Graphics solely to secure payment of the outstanding charges. Nothing in this clause transfers ownership of your pre-existing intellectual property. See also clause 6 (Shipping and Arrival Times) regarding uncollected orders.

3) Colour Accuracy and Hardcopy Proofs

  • We reproduce colour from submitted print-ready files as closely as possible, but exact matches cannot be guaranteed due to printing limitations, substrate/material differences (for example textiles, acrylic, wood), and neighbouring ink or LED colour requirements.
  • Where a hardcopy proof is provided and approved, colour accuracy is targeted to be within approximately 90% of that approved proof; if we materially fail to meet this standard, we will, at our discretion, reprint or replace the affected product at no additional charge.
  • No colour guarantee is given if you did not request a hardcopy proof or purchased a product that does not include a hardcopy proof option (for example many on-demand Articify items).
  • We accept no responsibility for colour variations between your device display (phone, tablet, monitor) and the actual artwork/product. Device brightness, calibration, and ambient lighting all affect perceived colour.

3.1) Binding Proof Standard

A hardcopy proof, where offered and approved, is the only colour reference we treat as binding for colour-tolerance purposes. Screenshots, PDFs, mock-ups, or on-screen previews are not binding proofs.

3.2) Live Content Previews

Any live or on-screen product previews on Articify (for example showing your uploaded image, name, or message on a lamp, garment, print, puzzle, or neon) are indicative only and may differ from the final physical product due to device display settings, print or manufacturing processes, substrate characteristics, and finishing tolerances. Previews are not colour-accurate proofs and may differ slightly in scale, positioning, or colour on the finished product.

4) Artwork Files & User Content

  • You are responsible for the accuracy and legality of your print-ready files and personalisation content and must proofread and check them carefully before submission.
  • By submitting a custom design or content, you represent and warrant that you have full rights to use it and that it does not infringe any third-party rights, including but not limited to copyrights, trademarks, design rights, privacy or publicity rights, or patents.
  • You agree to indemnify and hold Articify / Gozo Graphics Ltd. harmless from any claims, damages, or expenses arising from any infringement or alleged infringement of third-party rights related to the custom designs or content you submit.
  • Do not send one-of-a-kind physical originals by mail; we are not responsible for loss or damage to physical originals.
  • You must not upload material that could give rise to civil or criminal liability or that is illegal, defamatory, obscene, or otherwise unlawful. We cannot print sexually explicit (including photographic genitals) or violently explicit materials.
  • We will not sell client-submitted images or personalised artwork to other customers. However, images of finished Articify products may be used for marketing campaigns, advertising, and social media posts, unless you explicitly request otherwise before or at the time of ordering and we confirm acceptance of that request in writing.
  • Non-payment: see clause 2.3. If an order remains unpaid for 60+ days after delivery/notice, we may suspend or withhold deliverables and, as permitted by law and for business customers only, require assignment of certain production-file rights created by Articify solely to secure the debt.

4.1) Handling of Personally Uploaded Files

Files and content you upload (for example photos of people or pets, custom text, or artwork) are handled with care and are shared internally only as needed to process your order and provide the Service. We periodically perform housekeeping to optimise storage, during which older uploads may be deleted. If you want a specific file removed from our servers, you may request deletion at any time by emailing info@gozographics.com and identifying the file(s). We will honour your request unless we must retain the file to comply with legal obligations (for example accounting, fraud prevention, or lawful claims). This supports your GDPR right to erasure where applicable.

4.2) AI-Assisted Processing of Files

To provide and improve print/manufacturing quality (for example upscaling, denoising, artefact removal, background cleanup, basic retouching, or colour correction), we may use third-party AI/ML tools as part of our production workflow for Articify products. By uploading files and placing an order, you grant Articify / Gozo Graphics Ltd. a non-exclusive, worldwide licence to process your files for the purpose of producing your order and providing related support, which includes using such AI tools as sub-processors under contractual safeguards. We require our service providers to act on our instructions and we do not permit them to use your content to train their models or for their own purposes, unless you explicitly consent or choose an integration that states otherwise. Where you choose or request a specific third-party integration, that provider’s terms may also apply. Subject to applicable law, Articify / Gozo Graphics Ltd. is not liable for acts or omissions of independent third-party providers beyond our reasonable control.

Important: Timely payment avoids the above IP-related remedies and helps ensure a smooth production process.

5) Printing & Production Turnaround Time

  • Turnaround begins once your order is placed, payment is confirmed, and any required print-ready files or details are uploaded.
  • Typical turnaround for non-framed Articify items (for example many prints, garments, mugs, puzzles, neon desk lamps) is 3–7 working days, depending on product type and order volume.
  • More complex or framed products may require 7–15 working days or as specified in the product description. Always check the item description for product-specific turnaround estimates.
  • If files do not conform to our requirements or we require clarification, your job is set to “On Hold” and turnaround resets once corrected files or clarifications are received.
  • For jobs without complete digital source files, turnaround starts when we have the print-ready file(s) and required approvals.
  • If your job/proof is approved by 6:00 p.m. CET on a business day, turnaround begins that business day (otherwise on the next business day).
  • Facilities are generally closed Saturdays, Sundays, and major public holidays; these days do not count toward turnaround. Turnaround estimates exclude shipping time.

5.1) Processing & Delivery Estimates

All processing times, dispatch dates, and delivery dates shown on the Site or in our communications are estimates and may vary by product, destination, and order complexity. Estimated dates are not guaranteed and exclude delays outside our control (for example carrier issues, severe weather, customs inspections, or supply interruptions).

6) Shipping and Arrival Times

  • We offer various shipping options, which will be shown at checkout. Shipping costs are calculated based on the destination, shipping method, and order size/weight.
  • Transit times vary by location and carrier. We assume no responsibility for delays caused by carriers, customs authorities, weather, or other unforeseen events beyond our reasonable control.
  • International orders: may be subject to import duties, taxes, and charges levied by the destination country. These charges are the sole responsibility of the customer and are not included in our prices or shipping fees.
  • Where local pickup or collection is offered, pickup orders are generally held for 30 days from the date we notify you that the order is ready. After 30 days, paid orders may be disposed of or recycled; unpaid balances may be referred to our legal or collections department in line with clause 2.3.

7) Miscellaneous (Orders, Returns & Refunds)

  • Returns of standard Articify products: we generally accept returns of non-custom standard products within 14 days of receipt, provided items are unused, in their original condition, and in original packaging where possible.
  • Custom or personalised products: (for example items with your photo, text, or colour choice) are normally non-refundable unless they are defective, damaged in transit, or incorrect due to our error. Please contact info@articify.com with photos and your order details if there is a problem.
  • To initiate a return or replacement request, contact our customer service team at info@articify.com (or any service email shown on your order confirmation) for instructions. We may ask you to provide photos of the issue or to return the item to us.
  • Refunds or partial refunds, where approved, will typically be processed within 14 days of receiving the returned item or confirming that no return is required. Refunds are usually issued to the original payment method.
  • Except where mandatory consumer law requires otherwise, all sales are considered final once production starts (that is, after we receive your files, payment, and your job is in production). We cannot cancel or modify customised orders once production has begun.
  • If an order is created on the Site but not sent to production within 180 days (for example an unpaid or unapproved draft order), you may be eligible for a full refund of any amounts actually paid; after 180 days, no refund is available unless required by law.
  • Your printed or manufactured product or images will not be used in marketing without your prior written consent except as stated in clause 4 regarding generic images of finished Articify products.

8) Force Majeure

We are not liable for delay or failure to perform any obligation under these Terms where the delay or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, labour disputes, strikes, lockouts, supply interruptions, carrier failures, governmental actions, or utility outages.

9) Limitation of Liability (Orders)

IN NO EVENT WILL ARTICIFY / GOZO GRAPHICS LTD. BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR OTHER DAMAGES, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE, ARISING OUT OF OR IN CONNECTION WITH ARTICIFY ORDERS OR PRODUCTS. ARTICIFY / GOZO GRAPHICS LTD.’S ENTIRE LIABILITY UNDER, FOR BREACH OF, OR ARISING OUT OF PROVIDING THE SERVICES HEREUNDER IS LIMITED TO A REFUND OF THE FEES PAID FOR THE SPECIFIC PRODUCT OR SERVICE THAT GAVE RISE TO THE CLAIM. IN NO EVENT SHALL ARTICIFY / GOZO GRAPHICS LTD. BE LIABLE FOR YOUR COST OF PROCURING SUBSTITUTE GOODS OR SERVICES.

10) Indemnity (Orders)

You will defend and hold Articify / Gozo Graphics Ltd. harmless from claims, costs, expenses (including reasonable attorneys’ fees), liabilities, or losses arising from our use (acting as your agent) of copy, photographs, illustrations, or other content supplied by you that is alleged to be degrading, libellous, harmful, or to infringe any intellectual property, privacy, or other third-party rights; or from actions of your employees or representatives resulting from any mailing or distribution based on products ordered through Articify.

11) Website Use & General Terms

  • The following clauses govern your general use of the Articify online store and should be read together with the order-related clauses above and the Privacy Policy in Section B.

11.1) Copyright Notice

“Articify”, Articify-related logos, “Gozo Graphics”, “GozoGraphics.com”, and related marks are trademarks or trade names of Gozo Graphics Ltd. in Malta and/or other jurisdictions. You may not use, copy, or modify these marks without prior written consent. Use of our logos or names as a “hot” link to the Site requires our prior written approval.

11.3) Use Restrictions

  • You may use the Site only to make legitimate purchases or enquiries (“Requests”) and not for any speculative, false, or fraudulent Requests.
  • You may not use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.
  • You represent that you are of sufficient legal age and capacity to enter into binding contracts and that any information you provide will be current, complete, and accurate.
  • Placing a Request in a false name, with an invalid payment method, or otherwise misrepresenting identity is unlawful and may give rise to legal claims.
  • Permission is granted to copy or print portions of the Site solely as a shopping resource. Any other use, including reproduction, modification, distribution, transmission, display, or performance of the Site or Content, requires our prior written consent.

11.4) Email and Submissions

We may not be able to respond to all submissions or enquiries. We assume no responsibility for reviewing unsolicited ideas and have no liability for any similarities between such submissions and future products or services. You are responsible for material you submit by email or through the Site (for example reviews, comments, or design suggestions). Do not reveal trade secrets or confidential information in your submissions. Unless otherwise agreed in writing, all rights to materials and ideas you submit to us (excluding personal data governed by Section B) may, where legally assignable, become Articify / Gozo Graphics Ltd.’s exclusive property and may be used worldwide in any medium without obligation to you.

11.5) Privacy

Your use of the Site is also governed by our Privacy Policy in Section B below. By using the Site, you confirm that you have read and agree to that Privacy Policy.

11.6) Disclaimer of Warranty (Site)

WE DO NOT WARRANT THAT THE SITE’S OPERATION OR ANY CONTENT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

11.7) General Limitation of Liability (Site)

TO THE FULLEST EXTENT PERMITTED BY LAW, ARTICIFY / GOZO GRAPHICS LTD. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AFFILIATES (“COVERED PARTIES”) ARE NOT LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF (OR INABILITY TO USE) THIS SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. If a Covered Party is found liable for any loss or damage related to your use of the Site, such liability will in no event exceed the amount of any fees or charges assessed by Articify / Gozo Graphics Ltd. for the relevant Request or transaction.

11.8) Indemnification (Site)

You agree to defend, indemnify, and hold harmless Articify / Gozo Graphics Ltd. and its affiliates from and against any and all claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, your violation of these Terms, or your infringement (or alleged infringement) of any intellectual property or other right of any person or entity. You certify that you own or are duly licensed to use any images, designs, or content reproduced or manufactured as part of your Articify order.

11.9) Third Parties

If you submit Requests for or on behalf of a third party (for example a client, employer, or gift recipient), you are responsible for the accuracy of all information provided and must inform that third party of these Terms and any applicable rules or restrictions. You agree to indemnify the Covered Parties for any failures by you or the third party to fulfil obligations under these Terms. You are directly responsible for any Request submitted, including fees, charges, and performance obligations.

11.13) Miscellaneous

Section titles and headings are for convenience only and do not affect the interpretation of these Terms. Covered Parties are not responsible for any errors or delays in responding to a Request due to inaccurate or incomplete information provided by you or any technical problems beyond our reasonable control (including, but not limited to, internet failures, interruptions, or computer errors).

11.14) Entire Agreement

These Terms, together with the Privacy Policy in Section B and any additional terms or policies expressly incorporated herein, constitute the entire agreement between you and Articify / Gozo Graphics Ltd. with respect to your use of the Site and Articify orders, and supersede all prior or contemporaneous communications and proposals. We may update or amend these Terms by posting a revised version on the Site. If any provision of these Terms is held invalid, illegal, or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect.

11.15) Governing Law and Jurisdiction

The laws of Malta govern these Terms and any disputes or claims arising out of or in connection with them. You consent to the exclusive jurisdiction and venue of the courts located in Victoria, Gozo, Malta, without prejudice to any mandatory rights you may have as a consumer under applicable law.

  • Legal compliance and record-keeping (for example VAT, accounting, responding to lawful requests from authorities): Art. 6(1)(c) (legal obligation).

5) Cookies and Similar Technologies

We use both session and persistent cookies on Articify, including: necessary/essential cookies (for security, cart, checkout, and basic functionality), preference/functionality cookies, statistics/analytics cookies, and (where you consent) advertising and marketing cookies/pixels. Details are provided in our Cookie Policy (EU) available via the Site.

Where cookies are not strictly necessary (for example certain analytics/advertising/marketing cookies), we request your consent via our cookie banner or settings and record your preferences using our consent-management cookies (for example cookies similar to cmplz_*, typically retained up to 365 days). You can review or change your cookie preferences at any time via the cookie settings link on the Site or by clearing cookies in your browser.

About Cookie Controls, Comments & Third-Party Plugins

We use a consent-management platform to control non-essential cookies on Articify. If you leave a comment or review on the Site (where comments or reviews are available), we may store the data shown in the form, your IP address, and your browser user-agent string to help spam detection and security. An anonymised string created from your email address (a “hash”) may be provided to avatar services (for example Gravatar) to check if you are using them; please refer to the relevant service’s privacy policy.

If you log in or have an account, we may set cookies to remember your login and display preferences (for example screen options). Login cookies typically last for a limited period (for example up to two days or two weeks if “Remember Me” is selected), while preferences cookies (for example theme or language) may last up to one year. If you log out of your account, login cookies are generally removed.

Articles or product pages on the Site may include embedded content (for example videos, images, or posts from other websites). Embedded content behaves as if you visited the other website directly; such sites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with the embedded content. Some personal data may be shared with providers to deliver embedded content, analytics, payments, or support. We use reasonable efforts to configure and review these integrations and rely on appropriate safeguards (see sections 6 and 7).

6) Sharing of Personal Data

  • Service Providers/Processors: we share data with providers that help us run Articify, including hosting, payment gateways, shipping/logistics, communications, AI/ML upscaling or repair tools, customer support, and (where you consent) analytics and advertising. These parties act under our instructions and are bound by appropriate data-processing agreements.
  • Advertising & analytics partners (consent-based): where you consent to marketing/advertising cookies, we may share limited identifiers and event data such as pixel IDs, hashed email/phone, or purchase events to measure performance and personalise ads.
  • Affiliates: Articify may share data with affiliated companies within the Gozo Graphics group that honour this Privacy Policy.
  • Business partners: where needed to offer certain products, services, or joint promotions related to Articify.
  • Corporate transactions: in the context of a merger, sale of assets, financing, or acquisition, we may transfer data as part of the transaction, subject to confidentiality and applicable law.
  • Public authorities and legal obligations: we may disclose data when required by law, court order, or to protect our rights, property, safety, or that of others.
  • Some of these recipients may be located outside the EU/EEA; see the section on international transfers below.

7) International Data Transfers

Personal data may be processed in Malta and in other countries where our Service Providers are located. When transferring data outside the EU/EEA, we implement appropriate safeguards required by GDPR, such as European Commission Standard Contractual Clauses or other approved mechanisms, and apply additional measures where necessary. Where transfers occur to countries without an adequacy decision, we assess the risk and implement supplementary safeguards as appropriate.

8) Retention

We retain personal data only for as long as necessary for the purposes described in this Policy, including to comply with legal obligations (for example tax and accounting requirements), to resolve disputes, and to enforce our agreements. Order and invoice information is typically retained for the period required by Maltese law. Usage data (for example analytics logs) may be retained for a shorter period unless longer retention is necessary to improve security or functionality or required by law. Comments or reviews, if left on the Site, may be retained indefinitely to help identify and approve follow-up comments automatically instead of holding them in a moderation queue.

9) Your GDPR Rights

  • Access (Art. 15): the right to request confirmation whether we process your personal data and to obtain a copy.
  • Rectification (Art. 16): the right to request correction of inaccurate or incomplete data.
  • Erasure (Art. 17): the right to request deletion of your data, subject to legal retention obligations and legitimate interests.
  • Restriction (Art. 18): the right to request restriction of processing where conditions apply.
  • Data Portability (Art. 20): the right to receive certain data you provided to us in a structured, commonly used, and machine-readable format and to transmit it to another controller, where technically feasible and applicable.
  • Object (Art. 21): the right to object to processing based on our legitimate interests and to object at any time to processing for direct marketing.
  • Withdraw consent (Art. 7(3)): where processing is based on your consent (for example non-essential cookies or certain marketing), you may withdraw consent at any time; withdrawal does not affect the lawfulness of processing before withdrawal.

To exercise your rights, please contact us at info@gozographics.com or write to the address above. We may need to verify your identity before acting on your request and will respond within the timeframes required by law. You also have the right to lodge a complaint with Malta’s supervisory authority, the Information and Data Protection Commissioner (IDPC), or your local supervisory authority if you are located in another EU/EEA Member State.

9.1) Automated Decision-Making & Profiling

We do not make decisions that produce legal effects or similarly significant effects about you solely by automated means. We may use limited profiling (for example grouping customers by general interest or purchase history to tailor marketing) only where you have consented to analytics or advertising cookies. You may withdraw such consent at any time using our cookie controls or by contacting us.

10) Children’s Privacy

  • The Articify Service is not directed to children under 13 years of age, and we do not knowingly collect personal data from children under 13.
  • If you are a parent or guardian and believe that a child has provided us with personal data, please contact us so that we can take appropriate steps, including deletion where required.
  • For users aged 13–18, we may apply additional restrictions. Where consent is required by law, parental or guardian consent may be necessary before we process certain data.

11) Security

We use commercially reasonable technical and organisational measures to help protect personal data from unauthorised access, alteration, disclosure, or destruction. However, no method of transmission over the internet or method of electronic storage is 100% secure; we cannot guarantee absolute security.
